From VARA to FSRA: how the UAE became a global crypto hub

The UAE's goal of becoming a global hub for the digital asset industry led to a progressive and structured approach to cryptocurrency regulation. By creating regulatory frameworks that help maintain financial security for traders and investors, the UAE recognized early on that this was the best way to achieve that status.

Regulatory framework in the UAE

Within the UAE, there are three virtual-asset regulators: VARA, ADGM (FSRA), and SCA. These entities form the regulatory framework for virtual assets in the UAE, each with a specific jurisdiction and scope.

When it comes to the Virtual Assets Regulatory Authority (VARA), this entity oversees crypto-related activities within Dubai (excluding DIFC). VARA is responsible for creating and enforcing licensing and compliance requirements for Virtual Asset Service Providers (VASPs) in Dubai, which include setting and supervising the legal and operational framework for the licensed service providers. 

However, the Abu Dhabi Global Market (ADGM) is an international financial center in Abu Dhabi, and has its own financial regulator which is the Financial Services Regulatory Authority (FSRA). Tailored more to international businesses, the FSRA has issued comprehensive guidelines for digital asset activities beginning all the way in 2018, which include detailed guidelines for crypto exchanges and custodians from the issuance of Initial Coin Offerings (ICOs) and tokens, to the adherence to anti-money laundering and counter-terrorism financing guidelines, and everything in between.

Finally, the Securities and Commodities Authority (SCA) is the federal regulator in the UAE that is responsible for securities across the country. It works in coordination with VARA and ADGM, and also issues regulations for crypto trading and issuance outside of free zones, applying broader national financial laws.

Licensing structure 

There are a number of specific categories for licenses (e.g., exchange, custody, broker-dealer), which depend on the nature of the services these VASPs plan to provide. Despite differences in details, all these licensing categories have a few things in common, one of which is to require the licensed VASPs to adhere to anti-money laundering and counter-terrorism financing (AML/CTF) guidelines, as well as to maintain protocols such as  KYC (know your customer), all of which aim to ensure a clear, safe and compliant environment for traders and investors.

Regulatory vision and progress 

The UAE has always been known for being innovation driven and for its business-friendly environment. Its continuous support for industries like fintech is what has attracted several major crypto exchanges and blockchain firms to the UAE, especially given the UAE’s clear regulatory landscape that centers investor protection and maintains a strong focus on financial integrity.

This structured approach to crypto regulation is exactly why in 2022, Rain worked alongside the regulators in the UAE to obtain a Financial Services Permission (FSP). By 2023, Rain Trading Limited received its license from the Financial Services Regulatory Authority (FSRA) of Abu Dhabi Global Market (ADGM) to operate as a crypto-asset service provider within the UAE.

This licensing exemplifies the UAE’s approach that encourages innovation while ensuring compliance within a robust regulatory system. VARA, ADGM, and the SCA all contribute to the UAE’s clear regulatory framework and have all collectively positioned the UAE as a global leader in the industry.
