What is the GENIUS Act
The law introduces clear standards for stablecoin issuance and operation, with a focus on risk management, consumer protection, and financial transparency:
Full Asset Backing: All stablecoins must be 100% backed by U.S. dollars, Treasuries, or similarly liquid assets.
Licensing Tiers: Issuers with more than $10 billion in circulation fall under federal oversight, while smaller issuers can operate under state regulation.
Audit and Disclosure Requirements: Monthly public reserve disclosures are mandatory. Large issuers must undergo regular audits. In the event of insolvency, holders are prioritized.
Restrictions on Foreign Issuers: Foreign stablecoin providers must meet U.S. compliance standards and maintain domestic reserves to access the U.S. market.
Transition Timeline: Issuers have a limited window to come into compliance. After the deadline, unapproved stablecoins may be restricted from U.S. platforms.
Why This Matters
The GENIUS Act is the first major U.S. law to recognize and regulate stablecoins as a unique financial instrument. With more than $250 billion in stablecoins circulating globally, this legislation introduces guardrails for one of the fastest-growing areas in digital finance.

It follows the recent passage of the Clarity Act, which defines the regulatory split between the SEC and CFTC for digital assets, and comes amid a surge in institutional crypto adoption through ETFs, corporate treasuries, and payments innovation.
